Notes of Fines for Henry V TNA: CP 26/1/26
By Duncan Harrington
For an account of the notes for fines see Volume 4 part 9 pages 385-389. The notes for Henry V are contained in one large box stored off-site. Some attempt has been made at some stage to sort the notes into regnal years, although there is still an un- sorted portion. Once again many notes are in poor condition with some years being unrepresented. I have now examined all the notes. Those for Kent have been compared with the abstracts and any differences are given below.
This examination has thrown up the following differences.
(20) moiety of 32 acres not 2.
(22) one acre of meadow not 100.
(26) moiety of 80 acres marsh not land.
(28) word land is included in the note.
(30) John Ferrour.
(67) wife Alice.

Many notes are in a much worse state than the following:
by C.A.F. Meekings
The return day is the day mentioned in the Writ of Covenant as that on which the Writ had to be returned in Court. In the Tudor period, and for some time previous, this was used as the date of the Fine itself. The agreement might be made on that day or on any succeeding day before the next return day in the same Term. Where, for whatever cause, that was not possible, a day would be given in a later Term, on the same conditions. Such a Fine was said to be made at the earlier date and granted and recorded at the later one, and the later date became the legal date of the Fine in question. It must be remembered that the date of a Fine, according to the return day, can only be approximate, and is no evidence that the Fine was actually made in Court on that particular day.
By Tudor times the return days had become fixed, though a change was made in the sequence of return days in Trinity Term by the statute of 32 Henry VIII, c. 21. For fuller information the reader may profitably consult Sir William Holdsworth, A History of English Law (4th edition) volume iii, Appendix VII, and G. J. Turner, Introduction to Feet of Fines relating to Huntingdonshire, 1194-1603, (Cambridge Antiquarian Society, 1913) pp. cxxxviii- cxli. The following is a list.
Saint Hilary Term: octave of Saint Hilary (21 January); quindene of Saint Hilary (28 January); morrow of Candlemas (3 February); octave of Candlemas (9 February). Easter Term: quindene of Easter; three weeks from Easter; one month from Easter; morrow of the Ascension or Five weeks from Easter.
Trinity Term: until 1540, octave of Trinity; quindene of Trinity; morrow of Saint John Baptist (June 25); octave of Saint John Baptist (July 1); quindene of Saint John Baptist (8 July); after 1540, morrow of Trinity; octave of Trinity; quindene of Trinity; three weeks from Trinity.
Michaelmas Term: octave of Michaelmas (6 October); quindene of Michaelmas (13 October); three weeks from Michaelmas (20 October); one month from Michaelmas (27 October); morrow of All Souls (3 November); morrow of Saint Martin (12 November); octave of Saint Martin (18 November); quindene of Saint Martin (25 November).
The return days depending on Easter and Trinity were naturally movable, and insufficient is known about practice in relation to the return days in the old Trinity Term in the cases of a very early or late Easter. Where the day would fall on a Sunday or high liturgical Feast (double of the first class) the return day was adjourned to the Monday or next available day following. The normal dates for the legal Full Terms were:
Saint Hilary, 23 January to 12 February; Easter, third Wednesday after Easter to the Monday after the Ascension; Trinity (up to 1540), second Wednesday after Trinity to 10 July; Trinity, (after 1540), Friday after Trinity to the fourth Wednesday after Trinity; Michaelmas 9 October to 28 November.
Where the opening date of Saint Hilary and Michaelmas full Term fell on a Sunday it would actually begin on the day following and end one day later; the same also applies to the closing date of Trinity full Term until 1540. Legal Terms were sometimes adjourned, or not held at all, in this period the reader will find a full list in Turner's Calendar, passim, but it may be pointed out that there was no Trinity Term in the years 1528, 1545, 1550, and 1551, in the last three years for political reasons.
C. R. Cheney, A Handbook of dates for students of English History revised edition 2000 has some slightly different dates. For instance, Saint Hilary: Octaves of Saint Hilary [20-26 January]; Quindene of Saint Hilary [27 January – 2 February]; Three weeks after Saint Hilary or morrow of the Purification [3-8 February]; Octaves of the Purification [9-15 February]; Quindene of the Purification [16-22 February]. Readers are advised to read the account regarding the law terms published in this book.
